Welcome to Fotografia Productions. By accessing or using our services, you agree to the following Terms of Service. Please read them carefully.

1. Services Provided

Fotografia Productions offers all types of media and video production services, including but not limited to: concept development, pre-production, filming or video recording, recording of Sound, photography, post-production, editing, and final delivery of video or media content.

2. Project Timeline & Revisions

We work closely with clients to meet project deadlines. A standard project includes 1 round of revisions, unless otherwise agreed upon. Additional revisions may be billed at an hourly rate.

3. Payment Terms

A deposit of 50% is required to begin any project. The remaining balance is due upon the final day of production, or depending on the terms of the agreement, upon the final delivery. Late payments may incur fees or result in delays in project delivery.

4. Intellectual Property & Usage Rights

Upon full payment, clients are granted a non-exclusive, non-transferable license to use the final delivered media for agreed-upon purposes (e.g., marketing, social media, internal, personal, or commercial use).

Fotografia Productions retains the right to use footage or excerpts for promotional purposes (e.g., portfolio, website, showreel), unless otherwise agreed upon in writing.

5. Client Responsibilities

• Providing clear creative direction and timely feedback
• Ensuring all materials submitted (scripts, music, logos) are free of copyright infringement
• Securing necessary location or talent releases, unless the project agreement is to be by Fotografia Productions
• The client is responsible for obtaining production insurance to cover any damage, loss, or theft of Fotografia Productions' equipment, gear, or vehicles during the production period. This period is defined as beginning upon arrival at the first production location and ending upon departure from the final location. If the client chooses not to provide such insurance, they acknowledge full financial responsibility for any loss or damage, and agree to pay all associated costs as invoiced by Fotografia Productions in a timely manner.

6. Cancellations & Refunds

If a project is canceled before production begins, the initial deposit is non-refundable unless otherwise agreed upon in advance. In such cases, any refund will be issued minus any incurred pre-production costs. Once production has commenced, all payments made are non-refundable.

7. Limitation of Liability

Fotografia Productions is not liable for any indirect, direct, or consequential damages of any nature. While we take all reasonable steps to safeguard project assets, locations, project deliverables, recorded content, or any client production materials, we cannot be held responsible for loss due to technical failure, client delays, or force majeure events. Fotografia Productions will make every effort within its means—outside of financial responsibility—to help resolve any issues that may arise.

8. Confidentiality

Any confidential information shared during the project will be handled with discretion and will not be shared with third parties without prior written consent.

9. Governing Law

These Terms shall be governed by the laws of the State of [Your State], without regard to its conflict of law provisions.
